Please read these Terms of Service ("Terms") carefully before using the dB Monitor Pro mobile application (the "App") operated by Leverage Ventures Limited Liability Company ("we," "us," or "our").
## Acceptance of Terms
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
## Description of Service
dB Monitor Pro is a sound level meter application that uses your device's microphone to measure and display ambient noise levels in decibels. The App is provided for informational and personal entertainment purposes only.
## Disclaimer of Accuracy
IMPORTANT: The sound level measurements provided by this App are approximate and depend on your device's hardware capabilities and calibration. dB Monitor Pro is NOT a certified or professional sound measurement instrument.
The App should NOT be used for:
- Occupational safety or OSHA compliance
- Legal noise level documentation or evidence
- Professional audio engineering or acoustic analysis
- Medical, health, or hearing-related decisions
- Any purpose requiring certified sound level measurements
For accurate and legally compliant sound level measurements, please use professionally calibrated equipment.
## License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on devices that you own or control.
## Restrictions
You agree not to:
- Copy, modify, or distribute the App or its content
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices
- Use the App for any unlawful purpose or in violation of any applicable laws
- Use the App in any way that could damage, disable, or impair the App
## Intellectual Property
The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, and design) are owned by Leverage Ventures Limited Liability Company and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
## Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
## Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LEVERAGE VENTURES LIMITED LIABILITY COMPANY, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE APP.
## Indemnification
You agree to defend, indemnify, and hold harmless Leverage Ventures Limited Liability Company and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.
## Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Last Updated" date above. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
## Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
## Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms or the App shall be brought exclusively in the federal or state courts located in Wyoming.
## Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
